ZIX – End User Licence Agreement (EULA)

Important Notices

By downloading, using, accessing, playing, or purchasing ("Use") the ZIX client (the "Game"), you represent and warrant that:

• You are aware of the applicable age rating for the Game

• You are old enough to play the Game

• You have read, understood, and agree to be bound by this End-User Licence Agreement (the "EULA") in full

This EULA includes our Privacy Policy, which is incorporated herein by reference.

If you do not agree to this EULA, you must not Use the Game.
This does not affect your rights if the Game is defective.

Hidden IO Inc. ("Hidden IO," "we," or "us") reserves the right to amend this EULA at any time by posting an updated version at https://www.hiddengem.io/terms. Continued Use of the Game constitutes acceptance of such changes.

Where applicable, CD keys or activation codes are the sole responsibility of the original purchaser. Lost, stolen, or damaged codes will not be replaced.

1. Acknowledgements

• You accept responsibility for Using the Game on any device, whether owned by you or not.

• The Game may contain links to third-party websites. We are not responsible for their content, privacy, or data security.

2. Grant and Scope of Licence

We grant you a non-transferable, non-exclusive, non-sublicensable, revocable, limited licence to use the Game on a single device under your control for personal, non-commercial Use.

3. Licence Restrictions

You may not:

• Use the Game for distribution over a network

• Rent, lease, sub-license, reverse engineer, or modify the Game

• Use unauthorized software (cheats, bots, scrapers, etc.)

• Breach security or attempt unauthorized access

• Violate technology control or export laws

4. Acceptable Use Restrictions

You may not:

• Use the Game in any unlawful, offensive, or harmful manner

• Infringe on our or others' intellectual property rights

• Transmit unlawful, defamatory, or offensive material

• Overburden or interfere with our systems or other users

• Attempt to harvest data or intercept communications

5. Intellectual Property Rights

All rights in the Game and Online Features are owned or licensed by Hidden IO Inc.
You have no ownership rights and no right to access the Game's source code.

6. Fees and Payment

• Use of the Game may require payment.

• Fees and terms may change at our discretion.

• We may offer free promotions or waive fees at any time.

7. Game Functionality; Health and Safety Warning

7.1 Online Features

Online Features may require registration, fees, and are not guaranteed to be available.
An internet connection is required.

7.2 Usage Data

We may collect device and gameplay data (see Privacy Policy) for functionality and improvement.

7.3 Communication and Interaction

Users must act respectfully when using communications features.
We may monitor or remove content that violates these terms.

7.4 Patches and Updates

We may deploy updates or patches automatically, and you consent to such updates.

7.5 Health and Safety

Use of VR headsets is at your own risk.
Read and follow the health and safety guidelines provided by your headset manufacturer.
Discontinue use immediately if you experience symptoms like dizziness, seizures, or discomfort.

8. Termination

We may terminate this EULA immediately if you breach its terms.
Upon termination, you must destroy all copies of the Game.

9. Limited Warranty and Support

The Game is provided "as is" without warranties.
We do not guarantee error-free operation or availability of Online Features.

10. Limitation of Liability; Remedies

We are not liable for any business or indirect losses.
Our total liability is limited to the amount you paid for the Game.
Nothing in this EULA excludes liability for death, personal injury, or fraud.

11. Governing Law; Forum Selection

• Governed by the laws of Canada unless otherwise required by local laws.

• For users in the USA, governed by Nevada law.

• The United Nations Convention on Contracts for the International Sale of Goods does not apply.

12. Miscellaneous

• We may transfer this EULA to another entity.

• If parts of this EULA are invalid, the rest remains in effect.

• This EULA is the entire agreement regarding the Game and Online Features.
